Why Wont The Ferguson Unrest will never Cease.
WHAT WOULD HARRIET TUBMAN SAY ABOUT THE MUNICIPAL COURTS IF SHE WAS RESURRECTED FORWARD IN TIME?
What would sister Harriet say about the status of Negros today, would she say there exist a new slavery system with a plantation corporation that’s now
called Courts? The agents of this plantation, would she say they’d be called Judges, Prosecutors, Attorneys, and Overseers also known as the enforcers the Police? Would she recognize one’s employment being one’s position on the plantation, no matter the labor whether one is a prostitute, pimp, drug dealer, postal worker or doing carpenter’s work , etc, the fact slavery never ended at the end of the Civil War, it only expanded. The Plantation is no longer stationary on plots and acreages of land, now we have new age slavery, slaves in movement reporting to Courts to build these infulstructures, its all about extracting One’s money. Doesn’t it seem strange that courts of non-record, if one is found innocent one is still required to pay court cost. Even the saying’s of sister Harriet are still valid today, she’d still be saying would of freed more slaves if only the slaves understood they were not free. Articles IV and VI of the Constitution established the Peoples’ ‘Supreme Law of the Land’ to secure the Rights of the People, and to keep Government bound and in check by Official Oath, and by Official Bond. The 5th Amendment required that all persons within the United States must be given due process of the law and equal protection of the law. “The Constitution for The United States of America binds all judicial officers at Article 6, wherein it does say, “This Constitution and the Laws of The United States which shall be made in pursuance thereof, and all Treaties made, or which shall be made under the authority of the United States, shall be the Supreme Law of the Land, and the Judges of every State shall be bound thereby, anything in the Constitution or laws of any state to the Contrary, not withstanding.
Each person has the right to resist an unlawful arrest. In such as case, the person attempting the arrest stands in the position of a wrong doer and may be resisted by the use of force, as in self-defense. (State v. Mobley, 250 N.C. 476, 83 S.E. 2d 100)
“An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery. (State V. Robenson, 145 ME. 77, 72 ATL. 60
"The law provides that once State and Federal Jurisdiction has been challenged, it must be proven." Main v. Thiboutot, 100 S. Ct. 2502 (1980)
"Jurisdiction can be challenged at any time." and "Jurisdiction, once challenged, cannot be assumed and must be decided." Basso v. Utah Power
